I Have Been Arrested in Illinois, What Should I Do?
- Do not make a statement to the police! Remember the line from the movies – ‘Anything you say can and will be used against you’. It’s true. Don’t say anything about what may have happened.
- Immediately and affirmatively ask for a lawyer! Just say, “I want to talk to an attorney”.
- Don’t be rude! Be polite to the police officer, sheriff, FBI agent or other law enforcement agent. Being arrested is not a pleasant experience but chances are things will go smoother if you are polite. You may confirm your identity, address and date of birth.
- Lying will ALWAYS make your situation worse and may ruin possible scenarios for your defense. To put it bluntly, keep your mouth shut! Even if you feel you are not being formally interviewed, anything you say will be used against you.
